1. Acceptance of Terms

By accessing or using SongScribe.AI ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms at any time by posting the revised version on the website. Continued use constitutes acceptance.

2. Description of Service

SongScribe.AI provides instant, AI-generated custom songs, vocals, and audio based on user-submitted details, prompts, and instructions.

We offer multiple service tiers (Personal, Standard, Business, Exclusive, and Studio Pro), each with specific licensing, usage rights, revisions, and delivery conditions.

SongScribe is not a human music studio, composer, or publisher. Output is AI-generated and may vary in style, quality, or accuracy.

3. Eligibility

• Users must be at least 13 years old.
• Users under 18 require parental or legal guardian permission.

4. AI Disclosure

All content is generated by AI. Users acknowledge:

• Results may differ from expectations
• Style and quality may vary
• Minor audio artifacts may exist
• AI cannot perfectly reproduce famous voices or songs
• Similarities to existing works may occur unintentionally

5. User Content, Inputs & Restrictions

"User Input" includes all prompts, instructions, names, themes, and revision notes submitted.

By submitting, you confirm:

1. You own or have rights to use the content.
2. You will not submit copyrighted lyrics or melodies.
3. You will not request impersonation of real artists.
4. Content does not violate any law.
5. AI may interpret instructions unpredictably.

Prohibited Requests:

• Sexual, pornographic, or explicit content
• Violence or threats
• Hate speech, racism, extremism
• Illegal activity (drugs, fraud, terrorism, etc.)
• Adult content involving minors
• Copyrighted or "sound-alike" requests
• Requests to imitate or impersonate real artists

SongScribe may decline or modify any request at its discretion.

6. Copyrighted Names, Artists & Material

You may include personal names (e.g., "Ada," "David") in songs.

You may not request:

• Copyrighted lyrics or melodies
• Imitations of famous songs or artists
• Celebrity likeness or voice impersonation
• Songs intended to mimic copyrighted works

7. License Tiers & Usage Rights

Usage depends on the tier purchased.

7.1 Personal & Standard Plans (Non-Commercial)

Allowed: personal enjoyment, sharing with friends/family, posting on non-monetized social media

Not Allowed: monetization, business use, ads, branding, resale, Content ID registration

7.2 Business Plan (Non-Exclusive Commercial)

Allowed: commercial use, monetized social media, brand content, podcasts, paid ads

Not Allowed: claiming exclusivity, Content ID registration, reselling, AI retraining

7.3 Exclusive Plan

Allowed: exclusive worldwide commercial rights, full monetization, streaming, film/TV/corporate use, Content ID registration

Not Allowed: claiming authorship, resale as stock music, deceptive derivative works, AI model retraining without permission

7.4 Studio Pro (Subscription)

Unlimited generation for commercial and exclusive purposes with priority support and full licensing rights.

8. Delivery Times

Songs are generated and delivered instantly using our AI engine.

9. Revisions

The number of revisions and variations a user receives depends on the plan you select, as detailed on the pricing page and at checkout.

10. Refunds

All sales are final. No refunds for:

• Dissatisfaction
• User error in instructions
• Delays caused by incomplete input

Failure to deliver may result in store credit.

11. Payment Processors

We use third-party processors including Stripe, Flutterwave, Payoneer, and Seerbit.

All transactions must comply with processor terms. Card data is never stored by SongScribe.

12. Data & Privacy

Collected data: email, payment info, prompts/revision notes.

We do not sell personal data.

Anonymized data may be used to improve AI systems and service quality.

Users can request account deletion.

13. Prohibited Uses

• Deception or impersonation of real artists
• Training AI models using outputs
• Reverse engineering the platform
• Bypassing licensing rules
• Uploading non-exclusive content as exclusive
• Any harmful, illegal, or fraudulent activities

14. Termination

Access may be suspended or terminated for:

• Terms violations
• Illegal activity
• Harassment, abuse, or fraudulent chargebacks
• Misuse of licensing

15. Disclaimer of Warranties

Service is provided "as-is." No guarantees on:

• Accuracy
• Artistic satisfaction
• Similarity to existing works
• Availability or error-free output

16. Limitation of Liability

SongScribe is not liable for:

• Lost revenue or business
• Emotional distress
• Data loss
• Copyright disputes arising from user instructions

Your sole remedy is to discontinue use.

17. Indemnification

Users agree to indemnify SongScribe and its affiliates from claims, damages, or expenses arising from:

• User Input
• Violation of Terms
• Commercial use of generated content
• Copyright or legal disputes

18. Governing Law

Laws of the Federal Republic of Nigeria apply.
